A 66-year-old neighborhood watch captain has been sentenced to six months in jail after a felony conviction in November for pepper-spraying a man while arguing about his driving. On January 5th of last year Earl Boek followed Michael Gaglan home and berated him for running a stopsign at White River Drive and Redwood Boulevard. Haglan said Boek parked one of his tires on his lawn, and he was livid. Boek, who was still sitting in his car, said he felt threatened by Haglan so he shot him in the face with pepper spray from about 6 feet away. Boek was found guilty by a jury of felony illegal use of tear gas. He could’ve gotten up to 3 years in prison but was given a 6 month jail sentence. He’s not likely to serve any actual jail time because the judge ordered him to report to the alternative custody program. Boek still maintains that he was wrongly prosecuted.
